Terms of Use and Rules

1. Service provider

The operator of OM24.ee is Nedilko OÜ, registry code 17073523, Estonian Commercial Register (Äriregister), address Mustamäe tee 177-39, Mustamäe linnaosa, 12913 Tallinn, Harju maakond, Estonia.

2. Role of OM24

• OM24 provides technical tools for publishing and searching listings, saving favourites and communicating with other users.
• Unless expressly stated otherwise, OM24 is not the seller or buyer of an advertised item, a payment intermediary, or a party to a contract between users.
• Users are responsible for transaction terms, checking goods, payment, delivery, taxes and other obligations.

3. Accounts

• Provide truthful information and keep sign-in credentials secure.
• An account must not be used for fraud, spam, infringement of rights or circumvention of technical restrictions.
• Where a user lacks independent legal capacity under applicable law to enter into the service agreement, consent of a legal representative is required.

4. Listing requirements

• A listing must honestly and sufficiently describe the item or service actually offered.
• Price, condition, photos, location and other material information must not be knowingly misleading.
• The user must have the right to use any uploaded text, images and other materials.
• Mass duplication, keyword abuse and deceptive redirects are prohibited.

5. Prohibited content and conduct

• illegal, stolen or counterfeit goods, and offers that breach licensing, age or other mandatory restrictions;
• fraud, phishing, advance-fee scams, money laundering, identity theft or other deceptive schemes;
• illegal drugs, prohibited weapons or explosives, and other dangerous goods whose sale or advertising is prohibited;
• infringement of personal-data rights, copyright, trademarks, trade secrets or other third-party rights;
• threats, harassment, incitement to hatred, sexual exploitation, glorification of violence or other unlawful harmful content;
• spam, automated abuse, malware, circumvention of security measures or rate limits.

6. Moderation

• New or edited listings may be moderated before publication.
• OM24 may hide, reject, restrict or remove content that breaches these terms, applicable law, third-party rights or presents a credible security risk.
• We may restrict account functionality or close an account, particularly for repeated or serious violations.
• Where applicable law requires reasons for a content decision or an avenue to challenge it, we will provide that information in a reasonably accessible form.

7. Reporting illegal content

Allegedly illegal content can be reported through the OM24 electronic notice form or at support@om24.ee. A notice should contain the exact URL, a sufficiently substantiated explanation, name and email, and a good-faith confirmation that the information is accurate and complete. For notices concerning sexual abuse or exploitation of a minor, identity and email may be omitted. Where electronic contact details are provided, OM24 confirms receipt and communicates its decision.

8. Messages and contact data

• Use messaging primarily for communication related to a listing.
• Unwanted bulk messages, fraudulent links and other abuse are prohibited.
• Access to contact details may be subject to security and anti-abuse controls.

9. Intellectual property

Users retain rights in materials they create. By adding material to the service, the user grants OM24 a non-exclusive, royalty-free licence, limited to what is necessary to store, technically process, display, resize and distribute that material through OM24.ee while it is lawfully used in the service.

10. Service availability

We aim to keep the service secure and operational, but we do not guarantee uninterrupted availability or the accuracy of all information posted by users. Maintenance, security changes and feature updates may occur.

11. Liability

To the maximum extent permitted by applicable law, each user is responsible for their content, communications and transactions. OM24 is not responsible for performance of contracts between users, product quality, payment or delivery, except where liability cannot lawfully be excluded.

12. Account and content deletion

Users can remove their listings and use the account-deletion function. Limited retention may continue where required by law, a dispute, a security incident or the normal backup-rotation cycle.

13. Changes to the terms

We may update these terms when the service or legal environment changes. For material changes, we will publish the new version and, where required, give users reasonable advance notice.

14. Governing law and disputes

These terms are governed by Estonian law. Consumers retain any mandatory rights under the law of their country of residence that cannot be waived by contract. We aim to resolve disputes in good faith through support first.
